Nearly 90% of all Residential Real Estate Transactions in California rely on the contract known as the California Residential Purchase Agreement.  More commonly, this form which is created and supplied by the CALIFORNIA ASSOCIATION OF REALTORS® is referred to as the RPA.  The RPA and any Counter Offers or Addenda are the signed documents that comprise the real estate purchase contract.   Though not legally required, because of its comprehensive nature, the RPA continues to gain popularity.

Unfortunately, the majority of real estate contracts never reach completion.   These contracts fail for numerous reasons: the buyer gets cold feet; the buyer can't qualify for the purchase money loan; or perhaps the seller won't reduce the purchase price or make repairs after an inspection reveals a defect.  Regardless of the reason, Vondrak Law can help you when the contract nears failure.  We will counsel you about your rights and obligations under the contract.  Because we have litigated numerous failed transactions in our representation of multiple real estate escrow companies, we understand the finer nuances of each contract clause in the RPA.  Even more importantly, we understand how to effectively implement demand forms to compel the other party's cooperation whenever a purchase transaction stalls or when you wish to cancel.
